Here are some important things you should know in case you encounter officers from Immigration and Customs Enforcement (ICE):
1, Regardless of your immigration status, everyone has rights under the U.S. Constitution. This includes the right to due process, the right to hire an attorney, and protection against unlawful searches and seizures. If ICE agents come to your home, you are not obligated to open the door. You can speak to them through a closed door or a window and ask them to show you a search warrant. Check if the warrant was issued by a court and signed by a judge (not just an immigration officer). Also confirm that your correct name and address are listed on the warrant. If there are errors or incorrect information, the warrant is invalid and you are not required to comply. 2. Remember that you have the right to remain silent and the right not to sign any documents. Without a valid search warrant, you may refuse searches of your vehicle, body, or belongings. Also, if ICE agents do present a valid warrant, know that you have the right to record video or take photos of the situation. As long as you are not interfering with a search or arrest, agents cannot force you to stop recording. However, if you are asked to step back, you must comply. So, what should you do if you encounter ICE agents outside your home or business? If you meet agents outside your home, ask to see an arrest warrant signed by an immigration authority. However, an arrest warrant is not a search warrant, so it does not give them permission to search your home, car, body, or belongings. If you are stopped by police while driving, you may be required to show your driver’s license and proof of insurance, but you do not have to answer questions about your immigration status. If you are arrested by police, you have the right to hire an attorney and make a local phone call. On the other hand, if you are arrested by ICE, the government is not obligated to provide you with an attorney. Recently, reports of ICE activity have been shared frequently on social media. While these posts may be well-intentioned, they can also spread fear and anxiety within communities. Always verify that the information you share or act on is accurate. |
